Terms of Use

Last updated: [DATE]

These Terms of Use (“Terms”) are an agreement between you and [COMPANY LEGAL NAME] (“RinkCoach”, “we”, “us”) for your use of the RinkCoach app and website (the “Service”). By creating an account or using the Service, you agree to these Terms and our Privacy Policy. If you don’t agree, please don’t use the Service.

1. Who can use RinkCoach

You must be at least 18 years old, or the age of majority where you live, to create an account. If you use RinkCoach on behalf of a team or association, you confirm you’re allowed to accept these Terms for it.

2. Your account

Keep your sign-in secure and let us know if you think someone else has accessed your account. You’re responsible for activity under your account.

3. Subscriptions and free trial

  • Free trial. Eligible new subscribers get a 7-day free trial. Unless you cancel at least 24 hours before the trial ends, your subscription begins and you’ll be charged at the end of the trial.
  • Billing. Individual subscriptions are purchased through the Apple App Store and charged to your Apple ID. Prices are shown in the app before you buy.
  • Auto-renewal. Subscriptions renew automatically for the same period unless you cancel at least 24 hours before the end of the current period. Your Apple ID is charged within 24 hours before renewal.
  • Cancelling. Manage or cancel any time in your Apple ID settings. Cancelling stops future renewals; you keep access until the end of the period you’ve paid for. Any unused part of a free trial ends when you buy a subscription.
  • Refunds. Refunds for App Store purchases are handled by Apple under its policies.
  • When access ends. If your trial or subscription ends, the app locks until you subscribe again or join an association. Your content is kept, as described in our Privacy Policy.
  • Price changes. We may change prices. Apple will notify you of changes to auto-renewing subscriptions as its rules require.

4. Association licenses

Associations and clubs may buy group licenses directly from us under a separate order or agreement. Coaches covered by a license join with an invite code and have access while the license is active and their seat is assigned. If the license ends or the association removes your seat, your access through it ends; you may subscribe individually to keep using RinkCoach.[Reference your association order form / license terms here once written.]

5. Coaching and safety

RinkCoach provides drill diagrams, practice plans and suggestions as coaching aids. You are responsible for running a safe practice.Always use your own judgment about whether a drill suits your players’ age, size, skill and the conditions on the ice; supervise players appropriately; and follow the rules of your governing body, league and rink. RinkCoach is not a substitute for coaching certification, medical advice, or your organization’s safety requirements.

6. Your content

You own the plans, drills, notes and feedback you create (“Your Content”). You give us a limited license to store, process and display Your Content only to provide the Service to you and anyone you choose to share it with. Don’t add content you don’t have the right to use, and don’t add personal information about players beyond what the app asks for (first name and jersey number).

7. Our content and the app

The app, its design, and the drills, animations and plans we provide are owned by us or our licensors and protected by intellectual property laws. We grant you a personal, non-transferable, revocable license to use the Service for your own coaching. You may share plans with other coaches using the app’s sharing features, but you may not resell, republish or redistribute our content outside the Service.

8. Acceptable use

Don’t misuse the Service. For example, don’t:

  • break the law or infringe anyone’s rights;
  • try to access accounts, data or systems you’re not authorized to;
  • reverse engineer, copy or scrape the app or its content, except as the law allows;
  • share invite codes outside the association they were issued to, or share your account.

9. Apple

These Terms are between you and us, not Apple. Apple is not responsible for the app or its content, has no obligation to provide maintenance or support, and is not responsible for claims relating to the app. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. Your use of the app must also comply with the App Store Terms of Service, including Apple’sLicensed Application End User License Agreement where it applies.

10. Changes and availability

We’re continually improving RinkCoach and may add, change or remove features. We’ll try to give notice of significant changes. We may update these Terms; if changes are material, we’ll tell you in the app or by email before they take effect.

11. Ending your use

You can stop using RinkCoach and delete your account at any time. We may suspend or end access if you seriously or repeatedly break these Terms, with notice where reasonable. Sections that by their nature should survive (such as 6, 7, 12 and 13) will survive.

12. Disclaimers and limitation of liability

The Service is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement, and we don’t guarantee the Service will be uninterrupted or error-free.

To the fullest extent permitted by law, we won’t be liable for indirect, incidental, special, consequential or punitive damages, or for injuries or losses arising from drills or practices you run. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim, or [$50], whichever is greater. Some places don’t allow these limits, so they may not apply to you.

13. Governing law and disputes

These Terms are governed by the laws of [STATE / COUNTRY], without regard to conflict-of-law rules. Disputes will be resolved in the courts of [COUNTY, STATE], unless the law where you live gives you the right to bring a claim elsewhere.[Decide with your attorney whether to add an arbitration clause and class-action waiver.]
